Terms and Conditions

Dutch Antiques

 

1.1 These are the Terms and Conditions referred to on the Invoice provided to the customer upon delivery of an item for service/ repair by Dutch Antiques.

 

2. When conditions apply

2.1 These Terms and Conditions apply to any repair service provided by Dutch Antiques.
2.2 These Terms and Conditions will prevail if there is any conflict between them and any oral communications.

 

3. Ownership

3.1 By submitting an item for service/ repair you confirm that you are:
a. the owner of that item; or
b. an authorized agent delivering the item on behalf of the owner.

 

4. Quotes

4.1 Quotes given upon delivery may be subject to change once your item has been fully inspected. If further charges apply we will notify you and await your consent before proceeding.

 

5. Liability

5.1 Dutch Antiques warrants that the service will be performed with due care and skill and in accordance with the relevant consumer protection legislation. Dutch Antiques makes no other express or implied warranties with respect to the service.
5.2 Dutch Antiques total liability to the customer under these Terms and Conditions is limited to that required under the Australian Consumer law.
5.3 Neither Dutch Antiques or any of its employees or agents are held liable for loss or damage resulting from shipment, transportation, fire, theft or any other circumstance beyond its control.
5.4 The customer must indemnify Dutch Antiques against any loss or damage to any property caused by any negligent act or omission or wilful misconduct of the customer, its employees or agents.
5.5 Liability is limited to the value of the damaged item.

 

6. Warranty

6.1 All services have a warranty of 12months from the date of the repair.
6.2 The warranty provided in 6.1 will not apply if a different warranty is noted on the Final Invoice or Written Estimate or agreed upon.
6.3 No warranty is provided on the mainsprings, weight cables, cords and chains, wooden and quartz movements.
6.4 No warranty is given on barometers.
6.5 Warranties are void if there is evidence that repairs or services have been done by someone other than Dutch Antiques or Jackson Clock Repair within the warranty period.

 

7. Timing

7.1 Any service response times stated or given by Dutch Antiques’ employees or agents are approximate only and will not form part of the Terms and Conditions.
7.2 If you do not wish to continue with the quoted service/ repair the item should be collected within 4 weeks of quotation
7.3 The final Invoice must be paid in full before the item will be returned to the owner.
7.4 Upon completion of a service or repair job the item must be paid for and collected by you within 4 weeks upon being notified of its completion.
7.5 After the 4 week period storage fees may apply.
7.6 We reserve the right to sell an item not paid for or collected within 3 months from the end of the 4 week collection period to cover the costs or any work and/ or storage.

 

8. Severance

8.1 If any provision of these Terms and Conditions is held by a competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions and the remainder of the provision in question will not be affected.
